A local former DPS officer from Riviera, TX named Andrew Smith who is 33 years old, was arrested and charged with a with indecency with a child - sexual contact, second degree felony.

The Texas Rangers arrested Andrew Smith on Tuesday, January 12, 2021.

Officials said investigations initiated after a juvenile made an shriek regarding the off-duty assault on Jan. 8.

Smith was later arranged in Kleberg County Jail after arrested and charged with indecency with a child, a second degree felony.

After a $40,000 bond, Smith is out of jail.

This man used to work for the Department of Public Safety 2010 then later worked as a Highway Patrol Sergeant in Falfurrias, TX and resigned before being arrested. Regardless of one's occupation, anyone can be guilty to commit such a disturbing act.

One can easily be fooled and can innocently think just by looking at someone and judging based off of their appearance, that many people are not capable of committing sexual contact with a child because it is not in our heads or heart to automatically believe so.

When this came across the news, it was sickening because anyone can generally be responsible for acting on something such as this.

It is very repulsive and infuriating when hearing news like this. Individuals involved with indecency with a child sometimes get away with it and hopefully get caught later on if a child speaks up. A child may be too afraid to speak up to an adult and not exactly knowing whether to believe the truth of what occurred. Most times in the child's head, they are manipulated by the offender and do not know what to believe and may think and believe it was OK.

Other offenders will do the time but eventually get dismissed in the future and I do not agree with this because Justice must be served at the end of it all.

The investigation remains in progress.
